Debt to Ukrenergo: energy trader United Energy lost a court case

United Energy demanded to cancel the clause of the rules under which the company’s debt of more than UAH 2.6 billion was accrued to the state-owned Ukrenergo. The court of first instance ruled in favour of the energy trader, but the decision was overturned on appeal. So the company filed a cassation appeal.
According to United Energy, the formula is discriminatory. At the same time, representatives of the NEURC and Ukrenergo clarified that Ukrenergo is not a business entity and cannot make a profit. This state-owned company acts as a dispatcher of the electricity market, the price of which depends on the balance of energy in the grid.
Having heard the parties' arguments, the panel of judges of the Administrative Cassation Court of the Supreme Court of Ukraine dismissed United Energy's cassation appeal and upheld the decision of the Court of Appeal.
The proceedings in the commercial case, where Ukrenergo is trying to recover the debt from United Energy, have been suspended until the final decision in this administrative case is made.
