Position of the NEURC
The Regulator officially confirmed that investigative actions were carried out involving Commission members Oleksandr Formagey and Kostyantyn Ushchapovskyi. In an official statement, the agency noted that the officials cooperated with law enforcement and complied with all legal requirements.
The NEURC emphasized the necessity of an objective investigation and adherence to the principle of the rule of law. Currently, the Commission members are refraining from public comments, citing the confidentiality of the pre-trial investigation.
Details of the Investigation
According to industry sources, the searches involve:

Kostyantyn Ushchapovskyi — a member of the NEURC since December 2021 (he also chaired the agency in 2022);

Oleksandr Formagey — a member of the Regulator since 2021 (he also served on the Commission in 2018-2019).
Investigators are verifying information regarding whether these officials may have advised Rostyslav Shurma on mechanisms to legalize "green" tariff payments for power plants in the Zaporizhzhia region that ended up under occupation.
Case Chronology
NABU and the Specialized Anti-Corruption Prosecutor's Office (SAPO) are investigating proceedings regarding the potential embezzlement of 141 million UAH. The case concerns solar power plants owned by associates of Rostyslav Shurma, specifically his brother Oleh Shurma (KD Energy 2, Renewable Energy Zaporizhzhia) and Ruslan Bozhko (Green Energy Tokmak, Grandpower LLC).
According to Bihus.Info investigations, these facilities received payments from the State Enterprise "Guaranteed Buyer" until the summer of 2023, despite likely having no connection to the Integrated Power System of Ukraine. Earlier, in July 2025, detectives also conducted searches at Shurma's residence in Germany.
