"In such circumstances, given the evidence available in the case file, based on the fact that the defendant repaid the principal debt in the amount of UAH 12,434,923,101.59 after the opening of the proceedings, the proceedings in this part are subject to closure," the court said in its decision.
As previously reported, the state-owned enterprise Guaranteed Buyer (GarPok) sued Energoatom to recover UAH 14.4 billion in debt for PSO for households. Of this amount, UAH 12.4 billion is the principal debt.
As stated in the court materials, the plaintiff claims that Energoatom violated its obligations under the contract for the provision of services to ensure the availability of electricity to household consumers in terms of full and timely payment of the cost of services for February 2023 - June 2024. At the same time, the last payment was made on 24.12.2024, which actually fully repaid the disputed debt.
In 2024, Energoatom allocated UAH 116.3 billion (excluding VAT) of its own funds, or 58% of its net income, to pay for PSO for households.

The Kyiv City Commercial Court has closed the proceedings in the case of Guaranteed Buyer's claim against Energoatom for UAH 12.4 billion after the debt under the PSO was repaid. The relevant ruling was published in the Unified Register of Court Decisions.
